Operator Terms of Service
1. Operator Eligibility. If you access the Service as an Operator, in addition to the representations and warranties in Section 3 of the Terms, you represent and warrant to us that, at all times while using the Service as a Operator: (a) you are a FAA Part 135 “on Demand” licensed aircraft operator; (b) you have not previously been suspended or prohibited from performing Flight Services as an aircraft operator or direct air carrier; and (c) your operations and your use of the Service are in compliance with all applicable laws, regulations, required to perform Flight Services as an aircraft operator or direct air carrier. You must immediately notify SharedCharter if you are no longer able to satisfy the foregoing representations. When you are registering for an Operator account, you will be required to provide us with certain information to demonstrate your qualifications.
1. User-Operator Payments. If you are an Operator who enters into a Flight Transaction with a User, then you acknowledge and agree that you are solely responsible for invoicing and collecting payment from Users. You agree to pay to SharedCharter and Brokers who facilitate the Flight Transaction a commission in accordance with normal business practices.
Part 135 Charter operators are welcome to list flights in the SharedCharter Database (SCD) if they are flights for which the Operator has a client willing to share such flight.
If a Sharer is paired by use of the SCD, then the Operator agrees to enter into an agreement to pay SharedCharter a fee for this pairing.
In the same way, Operators are welcome to search the SCD in order to find any flights that may fit a client the Operator has or will get for sharing. If a pairing is found, the Operator agrees to enter into an agreement to pay SharedCharter a fee for such pairing.
